Terms and Conditions of Hire

1. Contract of Hire - Bookings are subject to these terms and conditions being accepted in full by the hirer and all persons in the party. Bookings can be made by email and will be accepted once a deposit of 20% is received by us. If payment is by cheque by prior agreement, once that is cleared.

2. Confirmation of Booking - Bookings will be confirmed on receipt of your deposit and confirmation will be sent to you by either email or post stating the balance and due date without any further reminder for further payment.

3. Deposit - To secure your booking a non-refundable deposit of 20% of the total is required. Bookings can be made by email through the web site and will be held provisionally for seven days or until the full deposit is received/cleared, whichever is sooner. If your booking is made six weeks or less before the hire commencement date it must be accompanied by full payment. Should we not receive your payment within seven working days then your provisional booking will be cancelled. All payments shall be made by bank transfer or by cheque, by prior agreement, in £Sterling.

4. Final Payment - The balance should be paid a clear six weeks prior to the hire commencement date by bank transfer or cheque, by prior agreement, in £Sterling. If your booking is made six weeks or less before the hire commencement date it will be deemed provisional for seven days or until full payment is received, whichever is sooner. If we do not receive the balance by the fifth week prior to your rental commencement date, we will cancel the booking without prejudice and offer your slot to someone else.

5. Form of Payment - All payments prior to your arrival date should be paid by bank transfer or by cheque, by prior agreement, in £Sterling. Keys will not be released to anyone who has not paid in full. Payments due to you by us, e.g. refund of the damage waiver will be refunded to you by bank transfer or cheque, by prior agreement, in £Sterling.

6. Cancellation by Hirer - All cancellations of bookings must be in writing by email and notified to and received by us no later than six clear weeks prior to the rental period. If cancellation is prior to this deadline the deposit only will be forfeited. If cancellation is less than six clear weeks before departure the full hire cost is to be paid.

7. Alterations and Cancellations by Us - In the unlikely event that the apartment becomes unavailable due to circumstances beyond the control of us, the hirer will be offered a full refund. Any refund is only for the apartment hire costs. We are not liable for any cancellation or administration charges for travel arrangements, insurance, etc.

8. Amendment Charges - In the event you wish to alter details of a fully confirmed booking within the six week period we will do our best to accommodate the requested changes, but any increase in apartment rent will be paid by the hirer. Confirmation of the amendments must be sent by you to us in writing by email. We will respond in writing by email to you.

9. What is Included - The apartment rental includes the cost of a maid service pre and post occupation. This includes laundered linen, bath towels and tea towels, water, electricity and maintenance of the garden and patio. "Welcome pack" consisting of bread, margarine, water, juice, milk, tea/coffee, sugar, one toilet roll. Any defects or deficiencies must be reported within 24 hours of your arrival to the apartment representatives or by email. After this time it will be assumed that everything is in order. Please note that all towels are to be used within the apartment only and not to be used elsewhere.

10. What is Not Included - The apartment rental prices do not include personal, contents, travel and cancellation insurance, travel costs, transportation and airport transfers.

11. Air Conditioning - Air Conditioning Units are available in both bedrooms and the main living area. The use of these are included within your apartment hire price. We would like to state that to allow these units to work correctly and to save on power, thus saving the Earth's resources, all windows and patio doors have to be closed. To obtain cool air when windows and doors are open, the over-head fans are recommended.

12. Occupancy - Only persons listed on the booking form may occupy the apartment. The apartment cannot be re-let or sublet to any other group/ party or individual. Under no circumstances may more than four persons, as specified in the apartment description, occupy the apartment. PEN Apartments, or their representatives, reserve the right to refuse admittance to the apartment to the hirer and their party if they are in breach of this condition.

13. Hirer's Responsibility - The hirer is responsible for taking all reasonable care of the property and its contents. At the end of the hire period the property and its contents, including all equipment, furniture, utensils, etc must be left clean and tidy which includes the crockery and cutlery cleaned and stored in the appropriate cupboards and drawers. The hirer shall ensure that no member of the party engages in any activity in or around the apartment or complex which may cause damage, offense to the neighbours, pollution to the water or damage to the structure or filtration equipment, this includes unacceptable anti-social behaviour. The hirer shall also ensure that all rubbish is cleared away from the property and placed in the dustbins.

14. Damage to the apartment and its contents - Except in case of normal wear and tear, the hirer will be responsible for making good any damage to the apartment or its contents which has occurred due to negligence, wilful damage or irresponsible behaviour on the part of those occupying the apartment or their guests. Any damage must be immediately reported to us or the apartment representatives. The cost of the replacement or damage must be agreed with and paid for by the hirer. A figure of £100 is held against damage to the property, furnishings or excessive cleaning requirements. This is a non-smoking apartment. Should the hirer smoke inside the apartment or outside within the two patio areas they will be in breach of this contract. The cost of dry cleaning all fabrics and any additional cleaning of the apartment and the patio areas which is deemed necessary will be charged against the damage deposit.

15. Rights of Access - We or the apartment representatives have the right of access to the apartment at any time with due regard to the convenience of the hirer for the purpose of inspection of the property and to carry out any essential or routine repair or maintenance work. Any such access will only be undertaken following consultation with the hirer.

16. Responsibilities - Neither we nor our representatives can be held responsible for any circumstances beyond our control including, but not limited to, mechanical breakdown, illness, emptying of the Jacuzzi for necessary maintenance, failure of any public service supply. The hirer responsible for booking undertakes that no person in the party undertakes any activity which would endanger the policy of the apartment owner's insurance in respect of the apartment and its contents which might make the same void.

17. Injury and Damage - We do not have any responsibility to compensate you for any personal injury, illness, death, loss or damage of whatever nature suffered by you or any member of your party or any guests during the booking period or thereafter.

18. Accuracy of Information - We have taken a great deal of care to make sure that the information and photography contained in this web site is the best of our knowledge correct. However from time to time we may make changes to the apartment like decoration, furniture and fittings. All information supplied by us is given in good faith and is based upon the best information available at the time.

19. Apartment Arrival and Departure Times - The apartment will be available for occupation from 14:00hrs local time on the day of arrival and should be vacated by 10:00hrs on the day of departure. These times can be negotiable, but require written agreement via email prior to the holiday commencement. Booking periods can start and finish on any day of the week and can be for part weeks as well as complete weeks.

20. Keys, Directions and Local Contact Numbers - Detailed instructions for key collection and directions to the apartment will be sent two weeks prior to the rental commencement, together with local contact telephone number should you have any problems whilst at the apartment.

21. Complaints - In the unlikely event that you have a complaint about the apartment or its contents whilst on holiday it must be reported immediately to us or our representatives who will take reasonable steps to resolve the matter. Neither us nor our representatives shall have any liability for any complaint submitted after the completion of the hire period.

22. Building Work - Cyprus is undergoing development across the island and Mandria village is no different. However, when building works are taking place by local authorities, private developers or neighbours, it is important to note that we are not responsible for such work, are unable to stop such work taking place or unable to control the level of noise and dust, neither can we be responsible for any building work that starts during a holiday.

23. Force Majeure - We regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by "Force Majeure." In these Terms and Conditions of Hire "Force Majeure" means any event which we or the supplier of the service(s) in question could not, even with due care, foresee or avoid. Such events may include, but are not limited to, war, threat of war, civil commotion or strife, hostilities, strikes or other industrial disputes, natural disasters, fire, acts of God, terrorist activities, quarantine, epidemics, weather conditions, government action or other events outside our control.

24. Law and Jurisdiction - This agreement shall be governed by the laws of the United Kingdom to which both parties expressly submit.

25. Insurance - The apartment hire cost does not include any personal insurance cover of any kind. It is recommended that insurance is taken out against cancellation and that personal, contents, accident and medical insurances are also taken out.
